  • Payment and Delivery: Upon successful payment, users will receive an email containing a link to access the purchased Template stored on Google Cloud Storage. This link is personal to the user and should not be shared with others.
  • Use Restrictions: The Templates purchased through QuickPolicies.com are for your personal or internal business use only. You are not permitted to resell, distribute, or otherwise use the Templates for commercial gain outside the defined terms.

Use of Templates

  • License Grant: Upon purchase, Sivaiah Technologies Inc. grants you a non-exclusive, non-transferable license to use the Templates for your personal or business purposes only. You are not permitted to resell, distribute, modify, or create derivative works from the Templates without express written permission from us.
  • Permitted Uses: The Templates may be downloaded, filled out, and used for your internal or business purposes, subject to the limitations set forth in these Terms.
  • Prohibited Uses: You may not use the Templates for any illegal purpose or in a manner that violates applicable law. Templates may not be used to create fraudulent or deceptive documents. Payments and Refunds

  • Payment Processing: Payments for Templates purchased on QuickPolicies.com are processed through our third-party payment processor, Stripe. You agree to provide Stripe with valid and updated credit card information or other payment method details. By submitting such payment information, you automatically authorize Stripe to charge all purchase fees incurred through your account.
  • Refunds: Due to the digital nature of our Templates, all sales are considered final and non-refundable once the purchase has been confirmed and the Template link has been sent to your email. However, if the Template is proven to be significantly misdescribed or contains errors, we may, at our sole discretion, issue a refund.
  • Disputes: If you believe that you have been incorrectly charged, please contact us immediately to resolve the issue. We will review your claim and respond within a reasonable timeframe.

Promotions

  • Promotional Offers: From time to time, Sivaiah Technologies Inc. may offer promotional codes or discounts on QuickPolicies.com which can be applied to purchases of Templates. These promotions may be time-limited and may be subject to specific terms, conditions, and eligibility requirements which will be disclosed at the time of the offer.
  • Conditions: Promotions are subject to change and are offered at our sole discretion.
  • Redemption: To redeem a promotion code, enter the code at the time of checkout on QuickPolicies.com. The value of the promotion code will be deducted from the total cost of the purchase. Promotional codes are non-transferable, have no cash value, and cannot be exchanged for cash or credit.
  • Expiry and Restrictions: Promotional codes are valid until the expiration date specified and cannot be used in conjunction with any other offer. Sivaiah Technologies Inc. reserves the right to modify, cancel, or limit any promotion or offer without prior notice.

Prohibited Activities

Limitation of Liability

  • General Limitation: To the fullest extent permitted by law, Sivaiah Technologies Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (i) your access to, use of, or inability to access or use the Templates; (ii) any conduct or content of any third party on QuickPolicies.com, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties; or (iii) unauthorized access, use, or alteration of your transmissions or content.
  • Liability Cap: In no event shall the aggregate liability of Sivaiah Technologies Inc. exceed the greater of one hundred Canadian dollars (CAD $100) or the amount you paid Sivaiah Technologies Inc. in the past six months for the Templates in question.
  • Acknowledgment of Risk: You expressly acknowledge and agree that the use of QuickPolicies.com and its Templates is at your sole risk and that the entire risk as to satisfactory quality, performance, accuracy, and effort is with you.

Changes to Terms

We reserve the right,at our sole discretion, to update or modify these Terms at any time without prior notice. However, we will notify you of any significant changes to these Terms by posting a prominent notice on our website and/or by sending a direct communication. Your continued use of our site and services after any changes or revisions to these Terms shall indicate your agreement with the terms of the revised Terms.

Compliance with Law

  • Lawful Use: You are responsible for ensuring that your use of the Templates does not contravene applicable compliance or regulatory frameworks. You must not use the Templates for any illegal or unauthorized purpose. If you are unsure about the legality of using a particular Template, you are encouraged to consult with a qualified legal professional.
  • Indemnity for Non-Compliance: You agree to defend, indemnify, and hold harmless Sivaiah Technologies Inc. and its affiliates, officers, agents, employees, and partners from any claim, suit, action, or damage, including reasonable attorneys' fees, made or incurred as a result of your use of the Templates in violation of any law or the rights of a third party.

Dispute Resolution

If a dispute arises out of or in connection with your use of QuickPolicies.com or these Terms, we encourage you to contact us first at info@quickpolicies.com to attempt an informal resolution.

Should we be unable to resolve the dispute informally, we agree to resolve any disputes through the following process:

  • Negotiation: Both parties agree to attempt to resolve the dispute in good faith through negotiation within 30 days from the date of notification of the dispute.
  • Mediation: If negotiation fails, both parties agree to engage in mediation through a mutually agreed-upon mediator, in accordance with the mediation rules of the ADR Institute of Canada. The mediation will take place in Ontario, Canada, and the costs for the mediation will be shared equally between the parties, unless otherwise agreed.
  • Arbitration: If mediation does not resolve the dispute, the dispute will be settled by arbitration administered by the ADR Institute of Canada under its Arbitration Rules. The arbitration will be conducted in English and the location will be Ontario, Canada.
  • Arbitration Procedure: The arbitration shall be conducted by a single arbitrator and will be binding upon the parties. The arbitrator's decision will be final and enforceable in any court of competent jurisdiction.
  • Limitation on Claims: Any claims must be brought within one (1) year from the date on which the party bringing the claim first becomes aware or reasonably should have become aware of the act, omission, or default giving rise to the claim. There shall be no right to any remedy for any claim not asserted within that time period.

This section does not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.

The parties agree that any litigation not subject to arbitration, including seeking injunctive relief or any other interim measures, shall be brought within the courts of Ontario, Canada, to which the parties irrevocably submit to jurisdiction.

Indemnification

You agree to defend, indemnify, and hold harmless Sivaiah Technologies Inc., its officers, directors, employees, and agents, from and against any claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to QuickPolicies.com; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, trademark, privacy, or other property, or privacy right; or (iv) any claim that your use of the Templates caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of QuickPolicies.com.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
